This is an Agreement between You, the Member, and Positively Productive Systems LLC, Inc., (“Us” or “We”).
By agreeing to become a Member of the Positively Living Membership Community, you are accepting the terms and conditions in this
Membership Agreement.
Your Rights
Your membership will start immediately from the time you accept the terms and pay your initial membership fee.
You have the right to a positive and beneficial group experience.
Your Obligations
You agree to pay the applicable membership fee when you join online.
You permit ongoing charges to the account specified to be charged monthly or yearly, depending upon the membership selection.
You agree to maintain a currently activated debit or credit card account for payment processing.
If any payment due from you is not honored, you will be notified that your membership will be terminated due to non-payment. You can reinstate your membership by providing updated credit card account information for processing.
You confirm that you are at least 18 years old.
You agree that you have read and understand our privacy policy which is available on the Positively Productive Website.
You agree to tell us immediately of any changes to your personal details including contact information and payment methods.
Our Rights
We may terminate this Agreement and your Membership with immediate effect if you do not pay any applicable dues.
We may terminate this Agreement and cancel your Membership with immediate effect on notice to you if you consistently breach any of the Group Membership Rules outlined by your coach, causing an unpleasant and/or unbeneficial experience for other group members.
If we do not terminate your Membership if you breach any of the Group Membership Rules, or if we give you extra time to pay if you do not pay your Membership dues, we may subsequently enforce the terms of this Agreement.
We may communicate membership information by email or messaging.
We may assign the benefit of this Agreement and our rights to a third party provided we give you notice and your rights under this Agreement will not be prejudiced.
We may make reasonable changes to Membership Rules and to the Membership Agreement terms and conditions at any time.
We will send to you email confirmation of these terms using the email address you used when you joined.
Other Clauses
Only you, the person named in the online joining process, can benefit from this Agreement.
If any of the terms of this Agreement are invalid, unenforceable, or illegal the remaining terms can still be enforced.
This Agreement is governed by the laws of the State of New York.
You should print a copy of this Agreement for future reference.
Additional Services
Personal Coaching Sessions and “additional services” do not form part of this Agreement unless they have been specified as a bonus item.
Any “additional services” (i.e., coaching services) which you contract for or agree to pay for, do not form part of your Group Membership Agreement and the Terms & Conditions of this Agreement will not apply to them. You should be aware that if you enter into any agreement for “additional services”, you are entering into an agreement with those individuals under separate Terms & Conditions
defined by those specific services and service providers.
Both Parties Agree
Professional coaching is not therapy, counseling, advice-giving, mental health care, or treatment for substance abuse. A Coach is not a substitute for professional medical advice, financial assistance, legal counsel or other professional services.
Coaching is for people who are basically well-adjusted, emotionally healthy, functioning effectively, and wanting to make changes in their lives.
Coaching is designed to address areas the Client would like to consider. These could include (but are not limited to) career development, relationship enhancement, spiritual growth, lifestyle management, life balance, identifying plans of action, decision-making, productivity, and fulfillment. Coaching can involve exploring perspectives, brainstorming, questioning, values clarification, goal-setting, examining lifestyles, education, making requests, agreements to change behavior, and accountability.
Coaching is a confidential relationship and the Coach agrees to keep all information strictly confidential, except in those situations where such confidentiality would violate the law.
Coaching assumes that each person in the coaching relationship is guided by his/her own beliefs and values, and these are respected.
The Client is fully responsible for his/her well-being during the coaching relationship, including his/her choices and decisions.
The Client is responsible for his/her own achievements and successes and the Coach does not promise that the Client will take any specific action or attain specific goals.
